Terms and Conditions – DymoOnline

This website (the Site) is operated by Mega Thing Pty Ltd (ACN 634 002 609) (we, us or our), trading as DymoOnline. Orders placed via DymoOnline are packed and dispatched by Mega Office Supplies from Tweed Heads South, NSW 2486.

By accessing or using the Site, or placing an order, you agree to be bound by these Terms and Conditions and our Privacy Policy (together, the Terms). If you do not agree, please do not use the Site or place an order.

Acceptance

The Site is available at https://dymoonline.com.au/ and may be available through other addresses or channels.

By accessing and/or using the Site, users (you, your):

  • warrant to us that you have reviewed these Terms and our Privacy Policy;
  • warrant to us that you have the legal capacity to enter into a legally binding agreement with us (or, if you are under 18 years old, that you have your parent’s or legal guardian’s permission); and
  • agree to use the Site in accordance with the Terms.

If you are under 18 years old, you must have permission from a parent or legal guardian to place an order.

Registration

You may purchase products from us without creating an account, or you may choose to create an account. You must ensure that any personal information you provide is accurate and up to date. All personal information will be handled in accordance with our Privacy Policy.

If you create an account, you are responsible for maintaining the confidentiality of your login details. You are liable for all activity conducted through your account, including purchases made using your account credentials.

Orders

You may order products from us as set out on the Site. Any order placed through the Site is an offer by you to purchase a particular product or products for the price notified (including delivery charges and taxes) at the time you submit your order.

We may, at our discretion, accept or reject an order. We will endeavour to notify you of any rejection at the time of ordering or within a reasonable time thereafter.

Each order we accept results in a separate binding agreement between you and us for the supply of products in accordance with these Terms.

It is your responsibility to check order details, including selected products, quantities, delivery address and pricing, before submitting your order.

When you order and pay on the Site and your payment has been validated, we will provide you with order details which may include an order number, an order ID, billing and delivery addresses, and a description of the items ordered.

Please be aware that some products sold through the Site may not be suitable for children under 18 years old. Please take care when ordering products for use by minors.

Price and Payments

You must pay the purchase price of each product you order, plus any applicable delivery and optional insurance/protection costs selected at checkout (the Price). All amounts are stated in Australian dollars and include GST where applicable. Delivery and any optional protection costs are displayed separately from product pricing.

You must pay the Price using one of the payment methods made available on the Site. You must not pay, or attempt to pay, by fraudulent or unlawful means.

Promotional Discounts

We may from time to time issue promotional discount codes for certain products. To claim a discount, you must enter the code at the time of checkout. Conditions of use for discount codes will be stated at the time they are issued and may include expiry dates, minimum spends, or product exclusions.

Availability and Cancellation

All orders are subject to availability. We take reasonable steps to maintain accurate stock information, however stock levels may change.

We reserve the right to cancel an order at any time prior to dispatch where we cannot supply the products ordered (including due to events beyond our reasonable control), or where an error has occurred on the Site (including in relation to a product description, price, availability or image).

If we cancel an order, we will contact you using the details provided at checkout. We may offer a suitable substitute where available. You may choose a refund or store credit. If you have paid delivery costs for cancelled items, those delivery costs will be refunded for the cancelled items.

Delivery, Title and Risk

We deliver Australia wide. Delivery costs, delivery estimates and conditions are outlined in our Shipping Policy on the Site.

Any delivery timeframes displayed on the Site are estimates only and may vary based on carrier conditions, location, and product availability.

Title to products remains with us until you have paid the Price in full.

Risk in the products passes to you when the products are delivered to the delivery address specified in your order. Once risk passes, you are responsible for the products.

Returns

We offer refunds, returns and replacements in accordance with our Returns and Refunds Policy as set out on the Site. Nothing in these Terms is intended to exclude your rights under Australian Consumer Law.

Intellectual Property

All intellectual property (including copyright) developed, adapted, modified or created by us or our personnel in connection with the Site and these Terms remains vested in us.

You must not, without our prior written consent:

  • copy or use any of our intellectual property (in whole or in part);
  • reproduce, retransmit, distribute, sell, publish, broadcast or circulate any content from the Site to any third party; or
  • alter or modify any content, frame or embed any part of the Site within another website, or create derivative works from our content.

Limitations and Australian Consumer Law

To the maximum extent permitted by law, our aggregate liability arising from or in connection with the Terms and any products supplied will be limited to the portion of the Price paid by you for the products the subject of the relevant claim.

To the maximum extent permitted by law, we will not be liable for indirect or consequential loss, including loss of profit, revenue, business, goodwill, opportunity, savings, reputation, or data.

Nothing in these Terms is intended to modify or exclude any rights or remedies you may have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Route Shipping Protection

Route: Route Shipping Protection is an optional service that may provide coverage for eligible orders that are lost, stolen, or damaged in transit. If you decline Route, delivery outcomes are managed in line with our Shipping Policy and Australian Consumer Law.

General

Amendment: We may vary these Terms from time to time by publishing updated terms on the Site. The Terms that apply to your order are those in effect at the time you place your order.

Assignment: You must not assign any rights or obligations under these Terms without our prior written consent.

Entire agreement: These Terms contain the entire understanding between you and us in relation to their subject matter.

Governing law: These Terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.

Notices: Any notice under these Terms must be in writing and sent to the contact details below, or to the contact details you provided when placing an order or creating an account. Notices sent by post are deemed received 48 hours after posting. Notices sent by email are deemed received at the time of transmission.

Severance: If any provision of these Terms is held to be invalid or unenforceable, it will be read down to the minimum extent necessary, or severed, without affecting the remaining provisions.

Waiver: A failure or delay in exercising a right does not operate as a waiver. A waiver must be in writing.
